Brookwood House LLC – Guest Rental Agreement

 

PLEASE READ THE ENTIRE AGREEMENT.

 

This short term rental agreement (the “agreement”) constitutes a legally binding contract between the Guest(s) and Brookwood House LLC and their assigns (the “Host”). Guest(s) understand and agree that the rental agreement is non-negotiable. Terms and Conditions may change without prior notice.

 

The terms and conditions of your stay are presented below.

  1. Engaged Rental Parties – The contractual relationship is directly between the Host and the Guest and it’s entire party:
    1. The Host: Brookwood House, LLC.,hereafter referred to as the “Host” provides short term accommodations such as: short term vacation rentals, retreat venue, and an intimate gathering space. Property address: 7139 Starlight LN Boones Mill VA 24065
    2. Customers renting the property are hereafter referred to as the “Guests” or the “Guest”.The Guest(s) are obliged to provide their full names and up to date contact information. 
  2. Occupancy – Guest(s) understands that the Host will only accept reservations from responsible adults 26 years of age or above. Guest(s) who initiate rental will remain responsible for all other guest(s), children, or visitors during occupancy of subject property.
    1. Nightly and weekly rates are based on 6 person occupancy for our home. The maximum number of occupants allowed is 13. Premises may not be used or occupied at any time by more than the maximum number of occupants indicated. Adults and children, including babies of all ages, must be counted. Weddings and other celebratory events such as retreats are permitted with the Hosts approval.  In the case that a Guest will be having an event, Guest shall provide Event Liability Insurance with a one million dollar per occurrence minimum liability coverage and a minimum total coverage of two million dollars.
    2. No teen or college age groups are permitted even if chaperoned by adults. Rental to individuals under the age of 25 is not permitted and will carry a fine if the premise is booked for an underage group. 
    3. We reserve the right to require official identification showing a picture and date of birth.
    4. Overcrowding or misrepresentation is cause for immediate eviction and forfeiture of all funds paid. If the rental property is occupied by more than the number indicated on the confirmation, this will result in additional charges of $50.00 per guest per night.
    5. CHECK-IN TIME IS 4:00 PM – Host will use every resource available to have the Property ready for Guest occupancy at noted check-in time, however; Host cannot guarantee the exact time of occupancy due to possible interruptions.- No concessions, rate reductions, or refunds will be made for postponed occupancy due to conflicts out of Host’s control.
    6. CHECK-OUT TIME IS 10:00 AM – Checkout is strictly enforced so that the Host has adequate time to prepare the rental property for the next scheduled guest. Please follow all checkout instructions included in the Guest Welcome Book located within the rental home as well as available for download upon request. 
    7. Early arrival or late checkout may be available for an additional fee and must be pre-arranged. This option is not guaranteed.
    8. Pets are not allowed, occasionally we will allow small pets.  This  must be approved by the Host along with an additional 250.00 pet fee.
      1. Authorized PETS Only. All guests must receive prior approval for pets and standard pet rates will be included in the total cost of reservation.
      2. If an unapproved pet belonging to any member of the rental party, or guest of the rental party is found to be in or on the premises during or after property use, the guest fully understands that that they may be asked to vacate the property forfeiting all rental money and agrees to pay additional pet fee of 300.00. 
    9. Guest(s) must contact the Host as soon as possible to extend the reservation.  If the Host elects to extend the stay, the current nightly rate will be added to the reservation for each additional night along with any other associated charges. Hourly hold overs will be charged $25.00 per hour up to 3PM after 3PM the full nightly rate will apply. This option is not guaranteed.
    10. If the Guest coordinates a private event with the Host, up to 50 guests may visit the property in any single day, but not overnight.  See Event insurance.
  3. Rental Period
    1. The rental period commences at check-in time on the “Arrival Date” and ends at stated check-out time on the “Departure Date”. This rental period comes into effect unless different check-in and checkout times have been agreed upon prior with the Hosts approval, in which case the reservation and host shall redefine the rental period. This period is hereafter referred to as the “Rental Period”.
    2. The Guest has the right to occupy the property for the agreed upon Rental Period ONLY.
    3. The Rental Period dates will be stated on the reservation confirmation email provided to the Guest at the time of booking and cannot exceed unless with the written approval of the Host. The Guest will be liable for any extra cost when extending the length of guests stay.
    4. Arrangements can be made for a later  check-out, but this is subject to prior arrangements and an additional fee. If there is any early arrival there will be an early check in fee as well as any delay in vacating the property beyond the agreed time, a late check out fee is charged to the Guests.
    5. Note: This Agreement applies to the Guest’s stay from the “Arrival Date” to the “Departure Date”, but also to any other dates that may be included if the reservation is changed and approved by the Host.
  4. Confirmations – Reservation confirmation will be sent via e-mail to Guest(s). Please read the confirmation for accuracy: Occupancy dates, pricing, mailing address, phone/e-mail contact information, and any other accommodation requests. Information changes and/ or errors should be reported within 24 hours of confirmation.
  5. Reservation Changes – Once a reservation is confirmed a $25.00 Change Fee will be assessed for any date and/or property changes requested. Reservation Change Fee will also apply to the following requests:
    1. Guest(s) may request to change dates prior to thirty (30) days of original arrival date.
    2. The approval of any reservation change is at the discretion of the Host. There is NO guarantee that the request to reschedule the rental will be approved. If approved: any difference in cost will be adjusted.
  6. Cancellations 
    1. Cancellation by the Guest
      1. All Cancellations must be completed in writing (Email) Cancellations are not considered complete until Guest(s) receives cancellation confirmation email from Host. 
      2. In case of cancellation by the Guest, the Rental Amount is partially refundable. If the Guest cancels outside of 30 days prior to rental date, a fee of $500 shall be retained from the first payment. Cancellations made with less than 30 days notice, but at least 10 days prior to arrival date will result in the forfeiture of one-half of the initial rental payment. Cancellations made with less than 10 days notice, arrival date will result in the full forfeiture of the initial rental amount.
      3. If the Rental Agent is able to rent the Property for the entire Period of the Rental, the Rental Agent will endeavor to work out a reasonable refund, less an amount for the effort and rental commissions required to rent the Property.
    2. Cancellation by Host
      1. If a property becomes unavailable prior to occupancy due to circumstances outside of Hosts control or prior knowledge due to: Termination from rental program, major mechanical failure, or loss of utility (Electricity, Gas, Water) before offering a refund.  If there are no comparable options the Guest(s) will be given a full refund without penalties.
      2. In the event the Property is not available for use during the Rental Term due to reasons, events or circumstances beyond the control of Rental Agent, Rental Agent will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the Guest. If such replacement property cannot be found and made available, Rental Agent shall immediately return all payments made by the Guest, whereupon this Agreement shall be terminated and Guest and Rental Agent shall have no further obligations or liabilities in any manner pertaining to this Agreement.
  7. Termination by the Host
    1. The Host has the right to terminate a booking at any time on the grounds of abuse to the staff, mistreatment of the property, or criminal activity on the part of the Guest.
    2. Any sign of smoking inside the property will immediately terminate the booking, with no refund being offered.
    3. Upon notice of termination of this Agreement, Guest(s) shall vacate the premises immediately and forfeit all rents. A material breach of this Agreement by Guest(s), which, in the sole determination of the Host, results in damage to the Premises, personal injury to Guest(s) or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of Guest(s) tenancy. Violation of any of the rules contained herein will result in IMMEDIATE EVICTION & forfeiture of full amount of the rent paid.
  8. Security of Tenure
    1. No tenancy rights are created for the Guest(s) after the term of this agreement expires, which coincides with the published check-out time and is included by default in the Guest’s booking request.
  9. Rates – Nightly rates and minimum nights are displayed on the web site.
    1. Published nightly rental rates do not include cleaning fees, pet fees, Guest Services Fee, or any additional requested services. Nightly rates are subject to change without notice based on season and/or occupancy levels. Once a guest has secured a rate it will not change unless the reservation is modified by the Guest(s).
    2. All prices are quoted in confirmation email; unless otherwise specified, the price quotes include sales tax at the prevailing rates. All prices are based on rates prevailing at the time of quotation and may be subject to change. Unless Terms and Conditions otherwise specified, the prices quoted for all serviced property including utilities, taxes, and cleaning fees will be held on the credit card at the time of booking the reservation. Any extra charges are at the host’s and Brookwood House LLC discretion if damages are found upon walkthrough at check out. 
  10. Reservation Payment Requirements – A valid credit card must be used for initial payment.
    1. Payment of the balance is accepted by check or debit & credit cards, Visa, MasterCard, Discover, American Express, and JCB credit cards.
    2. Security – The primary credit card or any other type of credit card provided for payment will be used as form of security by Host for any guest fines, fees, or additional services due to guest neglect, misuse, or damage.
    3. The full price of the booking is due at the time of booking reservation. Payment for bookings must be completed online to secure the reservation. If this is not received on time, the Host reserves the right to cancel the booking.
    4. Any charges raised against the Host by their bank for handling dishonored checks or any other payments will be passed on to the Guest.
    5. Payment for bookings may be made by one of the following methods:
      1. Payment by credit/debit card is the preferred option for online bookings placed directly on the Host’s website.
      2. Cash or check payments will only be accepted in exceptional circumstances and with prior approval by the Host.
    6. By submitting a reservation over the internet or by phone said Guest has entered into a binding contract outlined by the Terms and Conditions of this Agreement. Upon submission Guest is authorizing “Brookwood House LLC” to bill charges relating to the rental and use of property. Guest accepts and understands all liability and costs associated with damage due to guest(s) negligence, misuse of property and/or missing items. Additional charges will be billed to the Guest(s) credit card kept on file for security. All credit card sales are final. Guest(s) understands and agrees to the refund and cancellation policies outlined herein.
    7.  If Host must obtain legal advice or counsel for matters arising from payment discrepancy involving a Guest or Payment vendor such as a credit card company, Host will seek rightful payment or collection. If disputes are transferred from Hosts management to a collection team or attorney, Guests of record will become responsible for all charges proved to be their responsibility including cost of collection services.
  11. Event Insurance
    1. If the Guest will be hosting an event, then Guest shall provide Event Liability Insurance with a one million dollar per occurrence minimum liability coverage and a minimum total coverage of two million dollars.  
    2. Guests shall provide a copy of the Certificate of Insurance naming Brookwood House, LLC, Adam Cohen and Elizabeth Woodstock as additionally insured. No event will proceed without this requirement being met.
  12. Accidental Damage Protection and Missing items: Brookwood LLC requires a valid MasterCard, Visa, American Express or Discover number on file for all reservations or a $1500 security deposit.
    1. The Guest will pay a Security Deposit of $1500.00 (one thousand five hundred dollars) which will be used as a guarantee for the Host in case of any damage to the premises during special events and/or for the replacement of any contents of the Property upon departure of the Guests.  Deposit will be refunded in full if there is no damage, in the event of damage the cost for any damages will be deducted from the deposit. Security deposit shall be paid with the final payment no later than 30 days prior to rental date.
    2. In Lieu of a Security deposit the Guest may provide an acceptable short term rental policy to the Host.  These policies shall be provided a minimum 30 days prior to Rental commencing. 
    3. Guests are held responsible for the cost for unintentional and intentional  damage to the Rental Property and its contents, not to exceed the amount of coverage purchased. 
    4. Guest authorizes Brookwood LLC to charge Guest’s credit card for any damage to the property,materials, and its contents.. Guests will be notified of any damage/costs in writing. Any material damage to the Rental Property will be charged immediately to the Guest’s credit card. Guest assumes full responsibility for any items damaged due to misuse or negligence or action on guest’s part, except in the case of normal wear-and tear reported to Brookwood LLC within 24 hours of check in, and for any items found to be missing.
    5. If there is any damage to the Rental Property or its furnishings, the Guest agrees to be responsible for the cost to repair any damages (not covered by Accidental Damage Protection) done by either Guest, Guest family, or Guest pet.
    6. Our Home is inspected after each Guest by the Host and reported to Brookwood House LLC  for appropriate billing. Brookwood House LLC has ultimate claim administration authority.
  13. Refunds
    1. All eligible refunds will be issued to the credit card on file. Cash Refunds are not available. Refunds or rate adjustments are not made for any inconveniences. No refunds or rent reductions will be made due to failure of appliances and/or equipment, early departures, delayed arrivals, or inclement weather. 
  14. Additional Fees
    1. If the guest is planning an event such as a wedding, it may be necessary for a representative of Brookwood House to be available for the event duration to help the renter facilitate caterers, rental firms, etc.  If this is the case an additional fee will be assessed.  This fee will be based on an hourly rate of $40.00 per hour.  No additional fee will be assessed if this is not required.
  15. Booking
    1. All bookings can be placed through the Host’s direct booking website, Airbnb, or VRBO. If a guest is emailing to inquire about certain dates the host cannot guarantee those dates will be available when the guest goes to book on the direct booking website as emailing is not a means of confirming a reservation as an alternative booking may take place in the meantime.
  16. Default 
    1. If Guest should fail to comply with the conditions and obligations of this Agreement, Guest shall surrender the Property, remove all Guest’s property and belongings and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.
  17. Property Condition
    1. The Property is provided in “as is” condition. Host shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access, fireplaces or other amenities as applicable. Host  shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible. The guest acknowledges that use of amenities such as pools, fireplaces, decks, creeks, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Guest’s own risk and indemnifies Owners and Agents of the property against claims incurred through guests use of these facilities.
    2. Guests shall use the Property for recreational, short-term purposes only (with an exception for approved events) and in a careful manner to prevent any damage or loss to the Property and keep the Property in a clean and sanitary condition at all times. The Property must be left in the closest possible condition to when Guests arrive. Guests and any additional permitted guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.
    3. Guests agree to further abide by all rules and regulations set forth in the Brookwood House Renter’s Guidebook.
    4. The Guest must follow the instructions in the welcome manual of the property including but not limited to keeping the property smoke free. A minimum of a $500 fee will be charged for any cigarette or other kinds of smoke product scents or other related damage left in or around the property. Any losses, damage, or cleaning necessary over and above normal servicing, the guest will be charged.
    5. By confirming your booking with the Host, the Guest authorizes Brookwood House LLC to deduct such payments and fees.
    6. The Guest is responsible for taking all reasonable care of the property and its contents. The property and all equipment, utensils, furniture, etc., must be left clean and tidy at the end of the Rental Period. No items can be removed from the property.
    7. The Guest will be responsible for reimbursing any damage to the property or its contents, which has occurred due to negligence, willful damage, or irresponsible behavior including breaking rules such as “No Smoking” on the part of those occupying the property or their guests. Without delay, such damage must be reported to the Host. The cost of the repair or replacement must be agreed with and paid to Brookwood House LLC.
    8. SMOKING – SMOKING IS NOT PERMITTED INSIDE FOR ANY REASON!! There is a $500.00 smoking fee if there is evidence of smoking inside the property that will be charged to the guests card upon check out.
    9. The Guest is responsible for ensuring that no person staying or visiting the property during the Guest’s stay will suffer anything to be done, which would endanger the policy of the Host’s insurers in respect of the property and its contents which might make the same void or voidable.
    10. Changing locks are not permitted and giving access arrangements to third parties is not permitted.
    11. Brookwood House LLC is privately owned, furnished, and equipped by the Owner and Host. As such, the Host cannot make any changes to the furnishings or equipment provided by the Owner. Property is cared for by a team of  housekeepers and is always inspected prior to arrival and immediately after departure.
    12.  If Guest(s) require special appliances or equipment, please bring them or make arrangements with the Host prior to arrival. Furnishings are subject to change without notice. Under no circumstances is furniture, bedding, mattress pads, utensils or any other item supplied with the rental property to be taken out, moved, or rearranged. 
    13. In certain areas of each rental property, there may be locked locations used by the property Owners for personal storage or for Housekeeping supplies. These areas are not included in this rental. Please do not move furnishings or tamper with locked areas, such behavior will result in a fine starting at $100.00 (or more depending on circumstances). 
  18. Right of Access
    1. Guest(s) agree that the Host reserves the right to enter the rental property to conduct an inspection at any time or for any reason. 
    2. The Host’s representatives and subcontractors have the right of access to the property at any time, with due regard to the convenience of the Guest, for the purpose of inspection of the property and for the Owners to carry out any essential repair or maintenance work.
  19. POOL and CREEK – Guests understand that pool and creek usage is at their OWN RISK and WILL NOT hold the Host or Owner responsible for any injury that might occur. The following rules and regulations govern use of the pool and creek:
    1. Swimming: Swim at your own risk. Never leave children unattended in the pool and or creek. No lifeguard on duty. 
    2. Children Swim Safety: Children age 13 and below must be accompanied by a responsible adult at all times. Please NO RUNNING and NO GLASS on the pool deck and walkways
    3. No diving into the pool is ever allowed since serious injury, paralysis, or even death, could occur.
    4. Damage to the pool due to tenant misuse, will result in additional charges to the tenant.
    5. Fishing. Guests may  fish from the pool deck and on the creek bank. It is guests responsibility to be aware and follow all applicable state fishing laws regarding licensure, catch limits, etc…
    6. There are risks associated when using the pool and creek. Guest agrees to use the pool and creek at their own risk. The Owner(s) will not be responsible for any injuries sustained by the Guest or the members of the Guest’s party when using the pool and creek. Guests who sign this agreement will be responsible to advise all other members of their party of all potential pool and creek hazards and rules.
  20. Quiet Hours begin at 10:00 PM and end at 8:00 AM.
  21. Repairs, Service Calls, Emergency Mechanical Failure
    1. Guest(s) understands and agrees that Host cannot guarantee against mechanical systems failure during occupancy.
    2. Guests must report any inoperative equipment or needed repairs to the Host’s host as soon as possible. Host will make every reasonable effort to have repairs completed quickly & efficiently. No refunds, concessions, or rate adjustments will be made for these unforeseen circumstances.
    3. Should a repair technician make a call to a rental property and find that the equipment is in working order and the problem was due to the Guests) oversight or neglect, the charge for service can be at the Guest(s) expense. Guest(s) understands and agrees that Host, Host’s staff, and/or contractor of Host may enter the rental property at any reasonable time to make any needed repairs.
  22. Directions and Previewing Property 
    1. Directions and specific property information such as where the house keys will be located will be provided prior to your day of arrival. Directions to our home will be provided via e-mail within 7-14  days prior to arrival and upon receipt of Guest Rental Agreement and final payment.
  23. Keys 
    1. Brookwood House LLC is privately owned and Guests are responsible for lost keys. The property must be re-keyed in the event the keys are lost, misplaced or not returned. Guests will be responsible for the cost of this procedure.
  24. Internet
    1. No guarantee can be made that the internet service provided will not experience technical issues during the guests stay.If the internet does go down we will work with our internet provider to get the internet back up and running as soon as possible.  The functionality of the connection cannot be guaranteed. Should the broadband connection not function for any reason, no liability is taken by either the owner or the Host, and they cannot be held liable for any losses resulting from the loss of connection.
    2. Wireless internet service is free to those guests who accept the terms and conditions below. By accessing the internet through Host’s Service, the Guest will be deemed to have read, understood, accepted, and agreed to be bound by these terms and conditions of use. Please do not use the Service if you do not agree to all of the terms and conditions.
    3. Network access codes or passwords provided to the Guest to access the Service should be kept confidential and not disclosed to any other person for any reason. The Guest will be responsible for any losses that arise from losing, misusing or otherwise disclosing any such access codes or passwords.
    4. The Service is intended to allow Guests to access the internet for legitimate purposes only. The Guest undertakes to the Host that their behavior while using the Service will be lawful, honest and proper. The Service may not be used in such a manner as to host a web or other server, send or facilitate the sending of bulk e-mail or collect third-party personal data without appropriate consent. The Host may terminate the Guest’s use of the Service at any time without notice it becomes aware of any behavior that has a negative impact on the Host’s equipment or network or the use by other customers of the equipment or network or the internet in general, or which damages, or has the potential to damage, the Host’s reputation or standing. 
  25. Linens and additional linen services
    1. A full supply of linen is provided. Bed linens and bath towels are not changed during your stay. Bath towels should not be removed from the property or used for cleaning purposes. Stained, misused, or missing linens will be replaced at Guest(s) expense. Contact the host before arrival to set this up. Note: Bath soap, toilet tissue, paper towels, and trash bags are provided during the rental.
  26. Trash and / or Litter 
    1. All trash must be bagged and placed in the trash cans or trash bin made available at the property
  27. Grill 
    1. Our property does have an outdoor cooking grill and it uses  propane. Propane grills should be turned off after each use. 
    2. Never use charcoal in a propane grill.
  28. Game facilities
    1. Games are provided and are designed for everyone’s enjoyment. Please respect the condition of these amenities and do not rough house or play hard around them. Children should always be monitored while using these amenities. Excessive wear and tear or misuse will result in repair or replacement cost at Guest(s) responsibility.
  29. Indoor Fireplace, Exterior Features and Firewood
    1.  Indoor fireplaces and exterior features are available in the fall and winter seasons only.
    2. Gas log fireplace – NEVER Re-arrange or tamper with gas logs. This is a major safety issue and could be hazardous to your health. Tampering will result in additional charges.
    3. Outdoor wood fire pit- Always start with a small fire and buildup to desired size. NEVER overload wood burning outdoor features. 
    4. Guests shall supply their own wood for the firepit.
    5. Due to the large volume usage of firewood with camp fires, fire pits, or similar, Guest(s) should stop at a convenience store or grocery store and pick up firewood to bring to Property for outside use.
  30. Parking
    1. Parking is not allowed on Starlight Lane. A maximum of three cars is allowed per Rental Party, and all cars must be parked in the driveway on the Property not blocking the upper driveway to the neighbor’s. In the case of an approved event, four cars may be parked at the bottom of the drive and up to 8 cars may be parked in the parking lot/driveway.
    2. Vehicles may only be parked in designated areas. If a vehicle is parked on or in front of an access route, or on the neighbors property after failed attempts to contact the Guest, the Host reserves the right to tow the vehicle away.
  31. The Guest agrees:
    1. Not to provide overnight accommodation for guests other than those declared to the Host in advance, under no circumstances.
    2. To pay for any losses or damage caused to the property but the guests or a member of the guests party
    3. To take good care of the property, leave it as they found it, and  leave it clean and tidy at the end of the tenancy.
    4. To permit the Owners and Host reasonable access to the property.
    5. Not to cause an annoyance or become a nuisance to the two neighbors and neighborhood road leading into Brookwood House LLC 
    6. Not to smoke in the home.
    7. Not to bring any pets to the property.
    8. To read any safety notices and advice upon arrival at the property.
    9. Not to re-let or sublet the property to any other group/party.
    10. To only use the property strictly for purposes agreed on when booking the property (intimate weddings, retreats, vacation rentals).
    11. Not to throw parties at the property without Host Approval. – If on arrival, it is felt that the Guest intends to use the property for such events, the Guest will be refused entrance.
    12. Not to light any candles inside of the property.
    13. In case of guest breaching these terms and conditions, the Guest will be required to leave the property immediately, and no refunds will be offered.
    14. In case of an emergency, the Guest is asked to:
      1. Make use of the fire extinguisher
      2. Reach out to the Host’s phone number if required.
    15. All properties are used at the Guest’s own risk. Parents should ensure that their children are supervised at all times.
  32. Cleaning
    1. The property will have been cleaned prior  to the Guest’s arrival. The Guest undertakes to notify the Host at their earliest convenience should they notice inadequate cleaning, so the Host can endeavor to rectify the situation. The Guest is asked to leave the property clean, ensuring that all used dishes are loaded in the dishwasher and turned on before departure.
  33. Risk of Loss and indemnification
    1. The Owner and the Host hold no liability for personal properties belonging to the guests left at the property during their stay.
    2. Any personal properties left at the property after the agreed check-out time may be moved, removed and/or disposed of by the Host.
    3. Neither Owner nor Host shall be liable for events beyond their control which may interfere with Guest(s) occupancy, including but not limited to acts of nature, governmental agencies, fire, strikes, war, inclement weather and/ or construction noise from nearby sites. NO REBATES,
    4. Guest hereby covenants and agrees to indemnify and hold harmless Brookwood House, LLC and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorneys fees incurred by Guest, permitted guests, visitors or agents, representatives or successors of Guest due to any claims relating to destruction of property or injury to persons or loss of life sustained by Guest or family and visitors of Guest in or about the Property and Guest expressly agrees to save and hold Rental Agent harmless in all such cases.
    5. The Host does not accept liability for any act, neglect or default on the part of the Owners or any other person, nor for any accident, damage, loss, injury, expense or inconvenience, whether to person or property, which the Guests or anyone connected with the Rental Period may incur. The Host nor the Owners shall not be held responsible for any maintenance/building works outside the rental property now and in future.
  34. Complaints
    1. Any complaints about the property, its contents, or the Host staff must be made immediately by both of the channels below:
      1. via phone call to the hosts phone number provided at time of booking
      2. via email to the Host’s address
      3. All complaints must be notified to the Host as soon as reasonably practicable, as the Host may be required to carry out an on-the-spot investigation/ fix  and, if necessary, request the Owner to take remedial action. Should you have a complaint, please allow the Host the opportunity to put matters right during the Rental Period.
      4. The Host will take all reasonable steps to settle the problem. Brookwood House LLC shall not be held liable for any complaint submitted after the completion of the Rental Period.
      5. The Host will not be liable for any delay, loss, damage, or expense incurred if the Guest’s booking needs to be altered or canceled or The Host is unable to perform its contractual obligations as a result of events beyond its reasonable control.
  35. Release
    1. Guest hereby waives and releases any claims against Brookwood House, LLC, the Property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by Guest on or near or adjacent to the Property, including any common facilities, activities or amenities. Guest agrees to use any such facilities or amenities entirely at the Guest’s own initiative, risk and responsibility.
  36. Travelers Insurance 
    1. If desired, guest(s) are urged to purchase a travel insurance policy may be made available by a third party insurance vendor. This policy can cover any monies lost based upon the coverage provided. The option to purchase this travel insurance policy must be exercised by the guest.
  37. Behavior and Disorderly Conduct
    1. NOTICE: There should be No drinking of alcoholic beverages by persons under the legal age of twenty-one (21) allowed. Should a Guest(s) or visitor of Guest(s) be arrested for underage drinking or use of any illegal substances while at the rental property, or should Host or staff of Host observe a Guest(s) or visitor of Guest(s) under the age of 21 consuming alcoholic beverages or performing illegal activity, this rental agreement will be terminated and the Guest(s) evicted at the discretion of the Host. Illegal drug use is strictly prohibited. 
  38. Firearms, Fireworks and ATVs
    1. These items are strictly prohibited. If any evidence is discovered Guest(s) will be fined up to $500.00 (or more depending on circumstances) and will become responsible for any damages associated with the use of these items. Trailered ATV’s must be pre-approved prior to arrival and shall remain trailered at all times while on the property grounds.
  39. Privacy and Data Protection
    1. By using this website and supplying the Host with the Guest’s information, the Guest consents to the Host’s use of the Guest’s information as described above.
  40. Agency Disclosure
    1. Brookwood House, L.L.C., and the Host serves as the Host & representative in its rental program, & is acting at all times, in and for the best interests of the property and its owner(s).
  41. Disputes
    1. This Agreement contains the agreement between the parties with regard to the rental of the Property, and any changes, amendments or modifications hereof shall be void unless the same are in writing and signed by both the Guest and the Host. This Agreement shall be governed by the laws of the Commonwealth of Virginia. The words “Host” and “Guest” shall include their respective heirs, successors, representatives. The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waiver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the Agreement shall not be affected. Any notice required to be given under this Agreement shall be in writing and sent to the contact information included herein.
  42. Authority to Sign
    1. The person who places the booking certifies that he or she is authorized to agree to the Terms and Conditions on behalf of all persons being booked for, including those substituted or included at a later date, and that all these shall likewise observe the Terms and Conditions. They agree to take responsibility for the party occupying the property. In this sense, references to the Guest apply to all the property occupants. By placing a booking, the Guest is deemed to have accepted these Terms and Conditions. Payment of the full charge also indicates acceptance of these terms and conditions.
  43. Additional Terms to the Rental Agreement
    1. In addition to the standard terms included herein, Guest acknowledges and agrees that the following additional terms and conditions apply to the Guest’s rental of the Property:
      1. The Guest  acknowledges receipt of the Renter’s Guidebook, and agrees to follow all policies regarding expectations during the Guest’s stay, household rules, safety resources, and other guidelines relevant to the property and use thereof. The guest will and approve this contract unless they have received, read, and understand the Renter’s Guidebook.
      2. We recognize the hazards caused by scented products, so to keep a safe and healthy environment for all, the Host enforces a fragrance-free policy at the Property. Fragrances in personal care products, air fresheners, candles, cleaning products, and laundry products adversely affect human health. Scientific research links fragrance ingredients to a variety of health problems. All guests and visitors must refrain from using scented laundry, personal care, and cleaning products.
      3. The Caretaker lives on the property in a private suite. The amount of space listed and offered is not including this part of the house. The Guest acknowledges that the Caretaker may be present on site but will respect the Guest’s privacy and avoid shared spaces unless absolutely necessary.
